How to Navigate a DUI Checkpoint

The main goal of DUI checkpoints, according to the Kansas Department of Transportation (DOT) is to ensure that a driver who is drinking believes that they have a much higher chance of being caught. The checkpoint system essentially tries to intimidate people out of drinking and driving to begin with.   • Do Not Consent: You have the right to withhold your consent to any searches. Police officers are trained to look for “probable cause” that would allow them to search your vehicle. If you verbally refuse consent, your attorney may be able to argue that the search was unlawful.
  • Refuse Field Tests: You are not obligated to perform a field sobriety test – where you get out of your car to perform a series of coordination and motor skills tests. You are allowed to politely ask why you need to do this test and refuse, stating that you want to speak with your lawyer.
